Location of Courses:
The courses referred to herein are delivered at acc rekorder GmbH (rekorder studios) in Berlin,
Leuschnerdamm 31, 10999 Berlin, unless specifically stated otherwise. Please refer to individual course details on website or newsletter by Email at time of booking and shortly before the start of your course. Learners must ensure that they have confirmed the location of their course in advance.
Use of acc Rekorder GmbH Property:
Each learner is responsible for ensuring that no acc rekorder GmbH equipment or property is damaged, lost or stolen as a direct or indirect result of their own action or failure to act appropriately. Each learner is also responsible for the conduct of any guests they may invite on to the premises.
In the event that any acc rekorder GmbH equipment or property is damaged, lost or stolen as a direct or indirect result of the action or failure to act appropriately of any student or guest, the student agrees to pay all reasonable costs in full including replacement or reparation of such damaged property.
Student Conduct:
We expect all students to treat the staff, facilities and their classmates with due respect. acc rekorder GmbH reserves the right to exclude or expel any student whose conduct or behaviour is deemed unacceptable. In such cases, there will no be refund of course fee. Decisions are to be made at the management’s discretion.
Course Timetable:
acc rekorder GmbH reserves the right to change the dates, times and content of the courses if, in the unlikely event it is necessary.

Refund Policy:
Learners’ places are secured upon full payment or registration fee for Academy Programs. If learners provide express written notification of cancellation with more than 72 hours’ notice prior to the beginning of the course, acc rekorder GmbH will issue a 90% refund of any fees paid. 10% is to cover admin and incurred fees. With fewer than 72 hours’ notice, acc rekorder GmbH will not issue any refund, as we may not be able to fill the learner’s space in time. If in the extremely unlikely event we need to cancel a course, we will issue the learner with a prorated refund if a mutually agreeable alternative solution cannot be found, covering the time remaining on the course as determined by acc rekorder GmbH/Garnish. Example: if a course is cancelled 30% of the way through, a 70% refund will be issued. If a course is cancelled before the start, a 100% refund will be issued.
Special Requirements:
Please inform us of any special physical or medical requirements you have in advance, in order for us to try to meet them.
Learners’ Own Equipment:
Learners are responsible for any equipment they bring on to acc rekorder GmbH/Garnish premises. The learner is responsible for the software and must be the legal owner of software used on the premises.
Photo & Video Release:
ACC Rekorder Gmbh has the right to use film and photo footage to feature their presentations, promotional materials, in the advertising of the Company’s goods or services or on the Company’s website, in its original format or edited or altered in any way which the Company deems appropriate.

Accepts no responsibility for loss, damage or theft of personal belongings.
Reserves the right to alter advertised instructors at any time.
Reserves the right to cancel courses at any time and to transfer bookings to rescheduled dates. Students unable to attend rescheduled dates will be entitled to a refund or other credit.
Reserves the right to vary the course materials and to refuse any application or request for a course booking without giving a reason.
Takes no responsibility for the quality of services or products provided or offered by third party advertisers and/or vendors.
Attorneys Fees Provision:
In the event of any litigation arising from or related to services provided under this agreement, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable costs incurred including staff time, court costs, attorneys fees, and all other related expenses incurred in such litigation. In the event of a no-adjudicative settlement of litigation between the parties or a resolution of a dispute by arbitration, the term “prevailing party” shall be determined by that process.
Liability Waiver:
1. In consideration for receiving permission to participate in the activities at acc rekorder GmbH, you hereby release, waive, discharge, and covenant not to sue acc rekorder GmbH, the Board of Trustees of acc rekorder GmbH, their officers, agents, or employees (hereinafter referred to as Releasees) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury or other incidents that may be sustained by you, or to any property belonging to you, while participating in such activity, while in, on or upon the premises where the activities are being conducted, regardless of whether such loss is caused by the negligence of the Releasees, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law
2. You further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorneys’ fees that Releases may incur due to your participation in said activities, whether caused by negligence of Releasees or otherwise, to the fullest extent allowed by law.
3. You hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of Germany and that any mediation, suit, or other proceeding must be filed or entered into only in Germany. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions. The parties speculate to the personal jurisdiction of the state and federal court of Germany.
By taking your course, you acknowledge and represent that you have read the foregoing terms and conditions. You are aged 18 or over or you are the parent of a minor who is aged under 18 and you agreeing on his or her behalf.
Law and Jurisdiction:
These Terms and Conditions shall be governed by German law and the courts of Germany shall have exclusive jurisdiction over any claim, dispute or difference which may arise out of them.
Sever-ability:
If any provision is held unenforceable, all remaining provisions of this agreement shall remain in full force and effect.
Site Notice:
The website ber.garnishmusicproduction.com is operated under Licence of Garnish EDU Ltd. as a commercially independent division by ACC Rekorder GmbH as the legally responsible party.
